Privacy and Cookies Policy

1. I.Preliminary provisions

§ 1

Capitalized terms shall have the meaning assigned to them in the Rules of the Online Shopjustpaul.pl, whereas the term Customer shall mean, depending on the context, the Customer or the Internet User visiting the Shop websites.

§ 2

Just Paul Juszczyk-Grupińska Olechowska Sp. j., with its registered office in Warsaw (02-636), ul. Olimpijska 20, registered in the National Court Register under number 0000437376, NIP (Tax Identification Number) 5213638893, hereinafter referred to as the “Seller”, hereby introduces this Privacy and Cookies Policy, hereinafter referred to as the “Policy”.

II.Personal Data

§ 3

1.In order to use the services offered by the Seller via the Shop, the Customer must fill in an appropriate form. The form requires the provision of specified personal data.
2.The provision of personal data in the form is voluntary, but necessary for the Seller to render services for the Customer via the Shop. If the personal data are not provided, the services cannot be rendered.
3.Any personal data that the Customer will enter in the registration form, order form or in the correspondence with the Seller are processed in accordance with the requirements specified in the Polish law, and first of all in the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, hereinafter referred to as the “GDPR”.

§ 4

1.The Seller is the personal data controller.
2.The Seller may entrust the processing of collected personal data of Customers to other entity pursuant to the entrustment agreement of personal data processing concluded therewith.
3.If the Customer is registered via Facebook, the Shop will be provided with access to certain personal data of the Customer published on the Customer’s Facebook account (e.g. first name, last name, profile photo, e-mail address) in accordance with the policy applicable therein.
4.The Seller hereby informs that the personal data will be received by: entities providing hosting of the Shop or data for the Seller, suppliers of tools for: sending newsletters, analytics of the website traffic and marketing, payment operators, couriers and post offices, public authorities and offices.

§ 5

1.The Customer has the right to access his/her personal data, correct them, demand their deletion and limitation of the processing and the transfer of personal data. If personal data are processed contrary to the law, the Customer shall have the right to lodge a complaint with a supervisory authority, which in Poland is the President of the Office for Personal Data Protection.
2.The Customer has also two types of right to object to the personal data processing, if the personal data are processed:
a)for direct marketing purposes; this objection does not need to be justified;
b)based on other legally justified interests of the Seller; such objection requires justification with the Customer’s special situation.

§ 6

1.The Seller processes personal data of Customers and uses them in the scope and for the purpose of performance of services offered via the Shop, including the creation of the Shop account and performance of the concluded sales agreements, giving replies to questions presented by the Customer or solving the issue presented by the Customer to the Seller when contacting therewith and for marketing purposes consisting in the promotion and optimization of the Seller’s activities, its services and Shop operation (including by the analysis of the method of using the Shop and newsletter to adapt its content to Customers’ preferences), and after obtaining an additional consent – also for the purpose of sending the newsletter by e-mail.
2.The personal data are processed based on Article 6, section 1 letters b, c and f of the GDPR. The legally justified interest of the data controller is to conduct marketing for the offered services and the Seller, and give replies to questions presented by the Customer, and to solve the issue presented thereby.
3.Based on an additional and optional consent which the Customer may express in a separate statement, the Seller has the right to send newsletters to the e-mail addresses provided thereby, including information on new products or promotional campaigns, including that sent via terminal devices (e.g. computer, server) and automatic calling systems. If such consent is given, personal data shall be processed also based on Article 10 of the Act of July 18, 2002 on providing services electronically and Article 172 of the Act of July 16, 2004 – Telecommunications Law. If the Customer grants such consent, the consent may canceled at any time. The cancellation of the consent shall not affect the lawfulness of personal data processing before its cancellation.

§ 7

Personal data shall be processed for the time required for the provision of services to the Customer by the Seller and after the completion of provision thereof – for the time needed to demonstrate correct performance of the Seller’s obligations for the Customer. This period corresponds to the period of limitation of claims and tax liabilities. Personal data processed in the scope of marketing activities shall be processed in the period of performance of such activities by the Seller or the Customer’s objection against further processing of personal data for marketing purposes, or cancellation of the consent to send marketing information to the e-mail address. Personal data processed in relation to establishing contact with the Seller by the Customer shall be processed for the period necessary for giving reply to the Customer’s e-mail and solving the issue included therein.

§ 8

The Seller applies technical measures, required under the applicable personal data protection regulations, to prevent the obtaining and modifying of electronically sent personal data by unauthorized persons.

III.Cookies

§ 9

1.The Shop uses cookies, i.e. small text information stored in the Customer’s device, that may be subsequently read by the Seller.
2.Cookies are used for the following purposes:
a)adaptation of the content of the Shop to the Customer’s preferences and optimization of the Shop use; in particular, cookies allow for recognition of the Customer’s device and suitable display of the website, adjusted to the Customer’s individual needs;
b)maintenance of the Customer’s session, owing to which the Customer does not have to re-enter the login and password on each Service subsite;
c)adaptation of the newsletter to the Customer’s preferences;
d)detection of abuses related to authentication at the Shop;
e)marketing, including remarketing, i.e. displaying the Customer the advertisements concerning the Shop and the Seller on other websites.
3.The data controller uses external cookies for:
a.popularization of the Shop via social networking services: Facebook, Instagram.
4.As part of the Shop, two main types of cookies are used:
a.session cookies: temporary files which are stored in the Customer’s device until logout, leaving the website or closing the web browser;
b.persistent cookies: stored in the Customer’s device for the period defined in cookie parameters or until the Customer removes them.

§ 10

1.The Seller also informs the Customers that it is possible to configure the web browser so as to prevent the storage of cookies in the Customer’s device.
2.The Seller also indicates that cookies may be removed by the Customer once they are saved by the Seller, through: appropriate functions of the web browser, programs used for this purpose or use of appropriate tools available as part of the operating system used by the Customer.

§ 11

The Seller also informs the Customers that a change of the web browser configuration that prevents or limits the storage of cookies in the Customer’s device may result in limitations of the provided service functionality. Similar effects may result from deletion of cookies during the provision of services. This may cause the impossibility of logging in the Shop or interruption of the session after logging in.

§ 12

Cookies included in the Customer’s device may be used also by third parties cooperating with the Seller.

IV.Other

§ 13

It is not possible for the Customer to use the services provided via the Shop anonymously or using a nickname.

§ 14

The Seller will also register the IP No. of the computer used by the Customer to visit the Shop.
